1. Introduction
Welcome to Family Care App ("we", "our", or "us"). These Terms of Service ("Terms") govern your use of our mobile application and website (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date.
2. Eligibility
To use Family Care, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Service under applicable laws
The Service is designed to help families coordinate childcare between parents and grandparents. While the app references children, it is intended for use by adults only.
3. Account Registration
To use certain features of the Service, you must create an account. When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Keep your password secure and confidential
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorised use of your account
We reserve the right to suspend or terminate your account if any information provided is inaccurate, outdated, or incomplete.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates applicable laws or regulations
- Impersonate any person or entity, or falsely state or misrepresent your affiliation
- Interfere with or disrupt the Service or servers connected to the Service
- Attempt to gain unauthorised access to any part of the Service
- Use the Service to transmit any harmful code, viruses, or malicious software
- Harvest or collect information about other users without their consent
- Use the Service for any commercial purpose without our prior written consent
- Engage in any conduct that restricts or inhibits anyone's use of the Service
5. User Content
You may submit content through the Service, including care requests, notes, and messages ("User Content"). You retain ownership of your User Content, but you grant us a limited licence to use, store, and display it as necessary to provide the Service.
You are solely responsible for your User Content and represent that:
- You own or have the necessary rights to submit the content
- Your content does not violate the privacy rights or intellectual property rights of others
- Your content does not contain unlawful, harmful, or objectionable material
We do not endorse any User Content and have no obligation to monitor it, but we reserve the right to remove any content that violates these Terms.
6. Family Connections
Family Care allows you to connect with family members to coordinate childcare. By connecting with another user:
- You confirm that you have a legitimate family relationship or caregiving arrangement
- You consent to sharing your profile information and care requests with connected family members
- You understand that other connected users can view your responses to care requests
You can disconnect from family members at any time through the app settings.
7. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are owned by Family Care App and are protected by international copyright, trademark, and other intellectual property laws.
Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
8. Third-Party Services
The Service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
You acknowledge and agree that we shall not be responsible for any damage or loss caused by your use of any third-party services.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- The results obtained from using the Service will be accurate or reliable
- Any errors in the Service will be corrected
Family Care is a coordination tool only. We do not verify the identity of users, conduct background checks, or guarantee the safety or suitability of any caregiving arrangements made through the Service.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAMILY CARE APP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless Family Care App and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any User Content you submit through the Service
12. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination:
- Your right to use the Service will immediately cease
- We may delete your account and User Content
- Provisions of these Terms that should survive termination will remain in effect
You may also delete your account at any time through the app settings or by contacting us.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on this page
- Updating the "Last Updated" date
- Sending you an email notification (for significant changes)
- Displaying a notice in the app
Your continued use of the Service after any changes indicates your acceptance of the new Terms.
